Notice of Privacy Practices

Below describes how information about you can potentially be used and disclosed and how you are able to access to said information. The Notice of Privacy Practices also outlines rights and choices you have and your healthcare provider responsibility denoted by HIPAA.

YOUR RIGHTS

Regarding your health information, you have certain rights. This section explains these rights and our responsibility to help you.

You have a right to an electronic or paper copy of your medical record or any other health information Clover Genetics has about you. You may ask us how to request this. If requested we will provide a copy of your health information, within 30 days of the request. A reasonable charge cost-based fee may be incurred. This will be sent via a secure attachment via email. If a new copy is required a new copy may be sent. If a paper version is desired this may also be sent but will incur a nominal but reasonable fee.

You have a right to ask Clover Genetics to correct your medical record if you think it is incorrect. We reserve the right to decline this request but will inform you within 60 days of the reasoning, however generally the information we have regarding your history is self-reported, if new information is obtained it is encouraged to share to ensure the appropriate assessment.

You have a right to request communication to be confidential such as a specific manner such as a particular phone or mailing address, if reasonable we will oblige. By default, communication will be through email or phone.

You have the right to ask us to limit how your information is shared for treatment, fee payment, and business operations. We retain the right to say no if this would affect your care. If the services you receive are paid in full out of pocket, we will oblige a request to not share information with a health insurer except where required by law. Please note if a receipt is submitted to insurance for reimbursement further inquiry from your health insurer may result.

You have the right to request a list of individuals or entities we’ve shared information with for the past 6 years to the date of the request and why. Disclosures provided will include any release except those regarding fee payment, treatment, and health care. A single list will be provided in a 12-month period, if any additional are requested in that time a nominal fee will result. Of note, we do not use or sell your information for marketing purposes.

You have a right to a paper copy of this notice.

You have the right to have someone make decisions on your behalf, such as if you have given medical power of attorney to another individual, or have a legal guardian. Before any action is taken confirmation of this status such as documentation will be performed.

You have a right to file a complaint if you feel any of your rights are violated. You may contact us directly if you feel your rights have been violated. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. This can be accomplished by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 2020, calling 1-877-696-6775, emailing OCRComplaint@hhs.gov, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/. No retaliation will result from filing a complaint.

YOUR CHOICES

For certain health information, you may tell us your choices about what we may share. If told what information you wish us to share below, if we can oblige, we will do so. You have a right and choice to tell us if you wish us to share information with individuals involved with your care, what to share in a crisis/disaster relief, in hospital directories, and fundraising indications. If you do not indicate to not contact you for fundraising efforts we may contact you but you are able to tell us to note contact you in this manner in the future. In the unlikely event you are unable to provide a preference, such as being unconscious, if believed to be in your best interest information will be shared. Information may be shared in the event to reduce a serious and imminent threat to health or safety.

We will never share information without written permission for marketing, sale of information, and most forms of behavioral health notes associated with psychotherapy as these receive special protections.  

OUR USES AND DISCLOSURES of health Information

During the course of your treatment, we may use your information and share it with other healthcare professionals who are also treating you. If a healthcare provider treating you reached out to Clover Genetics we will speak with them regarding your consultation if you have given previous verbal or written permission to do so. An exception to this rule would be in the event we are legally or otherwise compelled by law or regulation to do so, if you were to pass away and requested via a medical examiner, or if you are unconscious or otherwise unable to give consent and it would likely be important to imminent treatment.

We may use your information to run our organization to improve your care and contact you as needed.

We will use your information to bill for our services such as payment organizations, including insurance plans if insurance is utilized, and other organizations that process payment, such as a credit card companies. If an insurance company requests information based on a submission you have made for reimbursement we will provide this information.

Other ways in which your information may be shared

Information may also be shared for efforts to improve the public good such as research and public health efforts. We may share health information in reference to public health and safety for: Preventing disease, product recalls, adverse reactions medication reporting, reporting of suspected domestic violence, neglect, or abuse, and preventing or reducing a serious threat to any individuals health or safety, health research, organ procurement organizations, with a funeral director (in event of an individuals death), medical examiner, or coroner. We may also share health information about you to comply with state or federal laws, law enforcement purposes, health oversight authorities, worker’s compensation claims, in response to a subpoena or other court, or if compelled by other special government functions such as national security

Responsibilities of Clover Genetics

Law requires Clover Genetics to maintain the privacy and security of your PHI. If a breach occurs we will let you know within 72 hours. As described in this notice we will follow our responsibility and duties and provide a copy of this notice upon request. We will not share or use your information outside of the confines described in this notice. If you wish us to do so we require this in writing, which may be modified again in writing at any time if you change your mind.

Changes to the Terms of this Notice

We can change the terms of this notice, and any changes will apply to the information we have about you. Any new notice will be available on this website.

Health Privacy Notice

The policy below is written to inform those who are concerned regarding their Personally Identifiable information also known as PII. PII is any information that can be utilized to identify a single person.

What personal information do we collect from individuals who view our website and when?

We will collect information when provided through the Contact Us form when this information is input by the individual.

How is this information used?

We use this information to assist with any question you have asked or request an appointment. We will not share or sell this information to any third party without your written consent.

How is the information you provide protected?

Because most individuals who interact with our website are accessing healthcare services, all inputted information gathered via the website is stored in a HIPPA-compliant manner. If you desire us to modify or delete personal information you may request us to do so in writing. If you require a copy of any information we have, an email request can be made which will be processed within 30 days.

How do we protect your payment information?

A payment card industry (a.k.a. PCI) payment system external to clovergenetics.com will handle all credit/debit card transactions.

Yes, this website is run through SquareSpace which requires certain cookies in order to maintain functionality. You can find their cookie policy here: https://www.squarespace.com/cookie-policy . If you would like to opt-out of the use of cookies by going to your browser settings to warn you each time a cookie is sent or turn off sending of all cookies.

Disclosure of Data to any Third party

PII is not transferred in any manner to third parties without explicit written consent and when done so in compliance with the standards of HIPAA.

In the event of a data breach, what happens?

If Clover Genetics becomes aware that any data has been breached in any manner. You as well as the appropriate regulatory authority will be notified within 3 days(72 hours), if the data breach involves data patient additional steps will also be followed as compelled by HIPAA regulations. 

Individual Redress Principle: What is it and how does it impact you?

We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.
